ORDER OF DISMISSAL (Proposed Regulation)
A hearing on the above proposed regulation was set for September 17, 2007, at 10:00AM. ALC Rule 45 requires the agency to provide a statement, at least ten (10) days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp.2004) on the basis that a request for a hearing was made by twenty-five (25) persons, a governmental subdivision or agency, or an association having not less than twenty-five (25) members. The Court was advised by letter dated September 12, 2007, from Ronald W. Urban, Chief Counsel for Revenue Litigation Legislative Coordinator, that the Department did not receive any requests for a hearing on the proposed regulation in the above matter, and that the hearing will not be necessary. IT IS THEREFORE ORDERED that the above-captioned case bearing Docket Number: 07-ALJ-11-0336-RH is hereby dismissed. AND IT IS SO ORDERED. Carolyn C. Matthews, South Carolina Administrative Law Judge
