ORDER OF DISMISSAL

This matter is currently pending before the South Carolina Administrative Law Court. The Petitioner requested a contested case hearing following the Department of Revenue’s denial of the Petitioner’s request for a wholesale beer and wine permit based on the receipt of valid public protests as to suitability of the location by Patricia H. Allen, Edward J. Bernard, Rev. Msgr. James A. Carter, P.A., Diane Donald, Susan P. Dufie, Dorothy Fisher, Rev. Fr. Robert F. Higgins, Francis E. Hill, Nancy Lee Hill, Janet Mahan, Thomas M. Mahan, Katherine H. Mance, Denise Michels, Susan P. Miller, Carol and Joseph Nicolini, Nina Sossaman-Pogare, L. Timohty Sossaman, and Margaret C. Youmans. According to the Department, the Petitioner met the statutory requirements for the permit and but for the protests, the permit would have been granted. The Respondent notified the court by letter dated July 13, 2007 that all seventeen Protestants withdrew their protests.[1] Because the Department would have granted the permit but for the protests and those protests have been withdrawn, it is hereby:

ORDERED that this matter is remanded to the Department of Revenue to continue to process the Petitioner’s application and issue a wholesale beer and wine permit to the Petitioner for the location at CKK Wine Distributors, LLC, 1196 Russell Drive, Unit A in Mt. Pleasant, SC.

AND IT IS SO ORDERED.
