CONSENT ORDER

I. FACTS

This matter came before the Court upon the appeal from an Agency Final

Determination by the Respondent. The case involved the alleged violation of SC Code

Regs. § 7.200.4 in that the Respondent was accused of the transfer or sale of beer to an

underaged confidential informant, hereinafter “UCI.” The sale occurred on August 15,

2006, at approximately 5:03 pm.

The Respondent/owner Ronald Shelley Reid sold the beer to the UCI, and upon

realizing a possible error, ran outside to verify the UCI’s age. At this time he was

advised of the violation by SLED Agent Shannon Branham. The Respondent has no

previous violations, and no pending violations, against its license. (320317881-PBW).

II. AGREEMENT

The Department issued its Final Agency Determination and upheld the finding

that the Respondent had violated § 7.200.4 and assessed the fine of $500.00 for the first

violation against the Respondent pursuant to Revenue Procedure #04-04. And, the

Respondent, as a first time violator of §7.200.4, accepts this assessment.
