ORDER OF DISMISSAL

This matter is before the undersigned judge based on an appeal filed by the Appellant. On October 23, 2002, an Order Governing Procedure was issued and mailed to the parties. The Record on Appeal was timely filed by the Respondent on November 15, 2002. According to Rule 36 which existed at the time of the Order, the Brief of the Appellant was due on December 2, 2002. The Appellant submitted documents to supplement the Record on Appeal on February 20, 2003, but never filed a Brief as required by the Rules.

Upon motion of any party, or on its own motion, an administrative law judge may dismiss an appeal for failure to comply with any of the rules of procedure for appeals, including the failure to comply with any of the time limits provided by this section. ALC Rule 38.

It appearing that the Appellant has defaulted in this matter, this case is hereby DISMISSED.

AND IT IS SO ORDERED.
