ORDERS:
CONSENT ORDER OF DISMISSAL
This
matter comes before the South Carolina Administrative Law Court (“ALC”)
pursuant to the South Carolina Law Enforcement Division’s (“SLED”) issuance of
a citation to the Hutson Alley Partners, LLC (“the Licensee”) for violating 23
S.C. Code Ann. Regs. 7-200.4 (Supp. 2006) on June 1, 2006, by selling beer to
an individual less than 21 years of age. The South Carolina Department of
Revenue (“Department”) issued its Department Determination on October 13, 2006,
finding that the Licensee violated Regulation 7-200.4 on June 1, 2006 by
selling beer to an individual less than 21 years of age. This is the Licensee’s
second violation within a three-year period.
The
parties have now reached an agreement resolving this matter as follows:
1. The Licensee admits to violating Regulation 7-200.4 on June1, 2006, when
its agent sold beer to an individual less than 21 years of age, and will pay a
$2,500.00 fine.
2. The violation of Regulation 7-200.4 on June 1, 2006, will count as a
second violation in three years time for enhanced penalty purposes, under SC
Rev. Proc. #04-04.
Having
reviewed this agreement in settlement and compromise as set forth, I hereby
order its adoption and dismiss the Petition in this matter with prejudice.
