ORDER AMENDING CAPTION AND STRIKING CASE FROM THE DOCKET

This matter is before the Administrative Law Court (ALC or Court) pursuant to the Motion to Amend Caption filed by the South Carolina Department of Health and Environmental Control (Department) on September 20, 2004. In that motion, the Department set forth:

On September 2, 2004, the Department sent the Agency Transmittal to the Administrative Law Court. The Agency Transmittal mistakenly identified the Petitioner as Carolina Properties of Sumter, Inc., because the appeal letter was written on letterhead from Carolina Properties. On September 15, 2004, the undersigned counsel [Matthew S. Penn] spoke with Ronald E. Conner about the caption. This contested case involves property owned by Mr. Conner and he is the Petitioner.

The Department also set forth that Mr. Conner consents to this motion.

This matter is also before the Court pursuant to the Department’s Motion to Strike Case from Docket, filed on September 20, 2004. In that motion, the Department set forth that it has not made a final determination the Petitioner’s property is not suitable for a septic tank system and that a final determination will not be made until sometime in May 2005. Mr. Conner also consents to this motion. Therefore,

IT IS HEREBY ORDERED that the caption in this matter is amended so that Ronald E. Conner is now the sole Petitioner in this case.

IT IS FURTHER ORDERED that this matter shall be stricken from the active docket. Upon motion of any of the above parties, this matter may be reinstated without the additional payment of any filing fees. If neither party moves for reinstatement within one year from the date of this Order, this matter will be dismissed with prejudice at that time.

AND IT IS SO ORDERED.
