ORDERS:
CONSENT ORDER
On April 5, 2006, Petitioner filed Notice of Appeal of the conditional issuance of a private dock permit to him by Respondent S.C. Department of Health and Environmental Control. The case was assigned to the undersigned and, following the filing of Prehearing Statements, the matter was set for a contested case hearing to be held on August 17, 2006. Prior to the date set for hearing, the parties notified the Court they were engaged in discussion that might lead to a resolution of their dispute and requested a continuance of 90 days, which was granted. Counsel for the parties now advise the Court that Petitioner Golemis, by and with the consent of DHEC, wishes to withdraw his appeal without prejudice to his filing a new application for a private dock at the property in question.
Therefore, upon the joint Motion and Consent of the Petitioner and Respondent this matter is DISMISSED without prejudice.
AND IT IS SO ORDERED.
