ORDER OF DISMISSAL

This matter is before the Administrative Law Court (ALC or Court) pursuant to Respondent’s request for a contested case hearing regarding the South Carolina Department of Consumer Affairs’ (Department) September 5, 2006 decision regarding the alleged sale of contact lens without a prescription. On November 20, 2006, counsel for the Department submitted an Assurance of Discontinuance (Consent Agreement), signed by both parties, which resolved the issue in controversy. In find this agreement to be fair and reasonable. Accordingly,

IT IS HEREBY ORDERED this the agreement between the parties is approved by the Court and this matter is dismissed. The Court retains jurisdiction to enforce the agreement of the parties upon a petition by either party to enforce the terms thereof.

AND IT IS SO ORDERED.
