ORDERS:
ORDER OF DISMISSAL
The above-entitled case is pending before the Administrative Law Judge Division. It appears
to the satisfaction of the Division that this case has been fully and finally settled by agreement
between the parties, pursuant to a letter dated September 3, 2004, from Albert V. Smith, Attorney
for Petitioner, where Mr. Smith states that he is withdrawing his Appeal in this matter, and is
submitting payment for the penalty to the Department. There being no further controversy,
IT IS HEREBY ORDERED that the above-captioned case be and hereby is settled and
dismissed.
AND IT IS SO ORDERED.
