ORDERS:
ORDER OF DISMISSAL
This matter is before the Administrative Law Judge Division ("Division") for a contested
case hearing pursuant to the request of Henry C. Wingard and Lake Road Service Company
("Respondent") for appeal of Administrative Order No. 97-0116-UST, Site #06068. On September
11, 1998, counsel for South Carolina Department of Health and Environmental Control
("Petitioner"), filed a Motion to Dismiss the contested case on the basis that settlement was reached
between the parties. As a result, it appears to be no further controversy for consideration by the
Division.
IT IS THEREFORE ORDERED that this matter is hereby Dismissed with Prejudice.
AND IT IS SO ORDERED.
