ORDERS:

CONSENT ORDER OF DISMISSAL

This matter is currently before the Administrative Law Court upon an appeal of the decision of DHEC/OCRM to issue to Petitioner Nicholas Runza a dock permit, P/N # OCRM-2004-1E-082-R with reduced dimensions from that requested. The parties have now reached an agreement to resolve all issues in this case.

Upon motion and consent of all parties it is agreed as follows:

1.The Atlantic Intracoastal Waterway is of sufficient width to allow for special consideration of dock size.

2.The Petitioner wishes to rearrange the configuration of the current structure and increase coverage by 50 square feet from what is currently in place.

3.The Petitioner demonstrated sufficient geographic circumstances such that the dimensions requested are within an acceptable range based on configuration, width and surrounding structures.

4.An amended permit for a single family use dock will be granted to the Petitioner in the dimensions requested, consistent with the attached drawing.

5.All parties agree to a dismissal of this action with prejudice.

AND IT IS SO ORDERED.
