ORDER GRANTING MOTION FOR REMAND

This matter is before the Administrative Law Court pursuant to a request for a contested case hearing filed on June 3, 2004, regarding the South Carolina Department of Health and Environmental Control’s (Department) decision to issue Permit Number 18,845-AG to Harry Griffith, Triple H Broiler Farm, for the construction of four broiler houses.

This matter was previously scheduled for a hearing at 10:00 a.m. on September 23, 2004. However, on August 17, 2004, the Department filed a Motion for Remand, requesting that the Court remand the matter to the Department for further review and due to the Department’s desire to withdraw its decision to issue Permit Number 18,845-AG. No responses to this motion have been filed as of the date of this Order.

Having carefully reviewed the file and motion,

IT IS HEREBY ORDERED that the Department’s Motion for Remand is GRANTED.

AND IT IS SO ORDERED.
