ORDERS:
ORDER OF DISMISSAL
In the above-captioned matter, by letter dated February 10, 1998, Robert W. Harris,
Laboratory Director, advised this tribunal that Petitioner wishes to withdraw its request for a
contested case hearing. In his letter, Mr. Harris states that because of recent changes to EPA
methodology, the issues which are in dispute will be moot by the end of February. Thus,
Petitioner is pursuing an amenable solution with Respondent and no longer wishes to proceed
with a contested case.
IT IS THEREFORE ORDERED that the above-captioned case is hereby dismissed
with prejudice.
