ORDERS:
ORDER OF CONSOLIDATION
These matters were before me for a pre-trial conference on May 23, 1997. Based upon
information contained in the Pre-hearing statements filed by the parties, this tribunal inquired about
consolidation of the cases. It appears that both cases involve requests to review DHEC's decision
to issue 401 Water Quality Certification for thirty (30) U.S. Army Corp. Of Engineers Nationwide
Permits and coastal zone consistency certification . Both petitions challenge various aspects of the
certifications and request that they be denied. A hearing on each of these matters will result in a
duplication of witness testimony and exhibits. The same witnesses would testify in both matters and
the same relief is requested in each matter.
Pursuant to Rule 42(a) of the South Carolina Rules of Civil Procedure, judicial economy
dictates that the matters be consolidated into one contested case. Therefore, it is hereby
ORDERED, that the above captioned matters are consolidated.
It is further ORDERED that a telephone status conference will be conducted on June 30,
1997 at 10:30 a.m. The Administrative Law Judge Division will initiate the telephone conference.
AND IT IS SO ORDERED.
