CONSENT ORDER OF DISMISSAL

This matter is before the Court pursuant to request for a contested case hearing timely served by William T. Morrow, seeking review of the issuance of permit number OCRM-96-565. The permit application requested the construction of a 28' x 28' fixed pier with a roof and a 4' x 12' walkway with ramp leading to an existing 12' x 16' floating dock. The permit was issued with the condition that the 28' x 28' fixed deck be constructed landward of the critical line. A hearing was scheduled for August 4, 1997. No motions to intervene were filed. Prior to the hearing date, the parties notified the Court that an agreement had been reached to dismiss this action.

This Consent Order has been provided to the Court by the parties and represents their agreement that:

1. The 4' x 12' walkway will be increased to 6' x 12' wide walkway.

2. The fixed deck will be constructed in accordance with Attachment A of this Consent Order and is incorporated herein by reference.

3. Petitioner agrees to withdraw his appeal of OCRM-96-565.

THEREFORE, with the consent of the parties, it is hereby ORDERED that Docket Number 97-ALJ-07-0065-CC is hereby dismissed.
