ORDERS:
FINAL DECISION
This matter comes before the Administrative Law Judge Division on joint motion of petitioner and
respondent.
Petitioner appealed the terms and conditions of NPDES Permit No. SC0025933. After review,
DHEC staff has determined that the permit should be amended; the revised permit, which must be put on
public notice in accordance with the requirements of R.61-9, and the rationale document explaining the
amendments is set forth as an attachment to this order.
Accordingly, and with the consent of both parties, I find that the appeal should be dismissed without
prejudice, and the amended permit should be processed by DHEC in accordance with its normal procedures.
