Therefore, IT IS ORDERED that the above-captioned case be and hereby is settled and dismissed.

On October 16, 1996, the Petitioner, with the consent of Respondent, was granted an Order for Voluntary Dismissal Without Prejudice with leave to refile the action to the Docket within ninety (90) days of entry of the Order. The parties need to continue technical discussions relating to the permit under appeal past the time outlined in the original Order and with the consent of Respondent, the parties agree that the above-captioned action shall be taken off the active docket of the Administrative Law Judge Division and that Petitioner may reinstate this action in the future without prejudice.

The contested permit remains stayed and Petitioner shall continue to operate its wastewater system as provided by its current design. The parties will report on their progress within 180 days of entry of this Order.
